This Privacy Policy explains what data we collect, how we use it, how we protect it, and your rights regarding your data. We are a B2B platform serving real estate development professionals, and we treat your business data with the same care you would expect from a trusted advisor. |
1. Scope of This Policy
This Privacy Policy applies to all personal information and business data collected through the Pro Civil AI platform at www.procivilai.com, our mobile applications, APIs, and any other products or services that reference this policy. This policy applies to all visitors, registered users, subscribers, pilot participants, and prospective customers.
Pro Civil AI is a business-to-business (B2B) platform. Our primary users are corporate entities, and most data we process is business data rather than personal data of individual consumers. However, we process certain personal information of individual users (such as account credentials and contact information) and we apply the protections described in this policy to all data we collect.
2. Information We Collect
2.1 Account Information
When you register for an account or your organization subscribes to the Service, we collect:
(a) Contact information: name, email address, phone number, job title, and company name;
(b) Account credentials: username and encrypted password;
(c) Billing information: company billing address, billing contact name, and payment method details (processed and stored by our third-party payment processor; we do not store full credit card numbers); and
(d) Organization information: company name, address, state of incorporation, industry classification, and number of employees (approximate).
2.2 Platform Usage Data
When you use the Service, we automatically collect:
(a) Parcel search and selection history, including APNs, coordinates, and jurisdictions queried;
(b) Reports and outputs generated, including site plans, cost estimates, and proformas;
(c) Feature usage patterns, including which tools and modules you access and how frequently;
(d) Export history, including formats and file types downloaded;
(e) Watchlist and saved parcel data; and
(f) Session data, including login timestamps, session duration, and device/browser information.
2.3 Customer-Contributed Data
Certain customers contribute data to the Service under a Pilot Agreement or Data Collaboration Agreement, including:
(a) Historical construction cost data and unit pricing (earthwork, grading, paving, utilities, stormwater, landscaping, vertical construction, soft costs, and related line items);
(b) Bid tabulations and contractor pricing from completed projects;
(c) Project parameters including acreage, unit counts, product types, and jurisdictions; and
(d) Any other data voluntarily submitted through the platform or via file upload.
2.4 Technical Data
We automatically collect technical data when you access the Service, including IP address, browser type and version, operating system, device identifiers, referring URLs, pages visited, and interaction events. We use cookies and similar tracking technologies as described in Section 8.
2.5 Communications Data
We collect information you provide when you contact us, including email correspondence, support tickets, demo requests, newsletter subscriptions, and event registration information.
3. How We Use Your Information
3.1 Service Delivery
We use your information to provide, maintain, and improve the Service, including:
(a) Processing your parcel queries and generating platform outputs (site plans, cost estimates, proformas);
(b) Applying the correct jurisdictional data based on parcel location;
(c) Calibrating cost estimation models using anonymized, aggregated data;
(d) Providing customer support and responding to inquiries; and
(e) Processing subscription payments and managing your account.
3.2 Service Improvement
We use aggregated and anonymized data to:
(a) Train and improve our machine learning models for site plan generation, cost estimation, and feasibility scoring;
(b) Expand and update our development standards database;
(c) Identify and fix bugs, errors, and performance issues;
(d) Develop new features and capabilities; and
(e) Produce market benchmarking reports and aggregated analytics that do not identify any individual customer or project.
3.3 Communications
We use your contact information to send transactional communications (account confirmations, billing notices, platform alerts), product updates and release notes, market intelligence reports and newsletters (where you have subscribed), and event invitations and industry updates. You may opt out of non-transactional communications at any time.
3.4 Legal & Compliance
We may use your information to comply with applicable laws and regulations, respond to legal process (subpoenas, court orders), enforce our Terms of Service, protect the rights, property, or safety of Company, our users, or the public, and detect and prevent fraud or unauthorized access.
4. How We Share Your Information
We do not sell your personal information or business data. We share information only in the following limited circumstances:
4.1 Service Providers
We share data with third-party service providers who assist us in operating the Service, including cloud infrastructure providers (for hosting and data storage), payment processors (for subscription billing), analytics providers (for usage monitoring and performance optimization), email service providers (for transactional and marketing communications), and customer support tools. All service providers are bound by data processing agreements that restrict their use of your data to the purposes we specify.
4.2 Anonymized & Aggregated Data
We may share anonymized and aggregated data that cannot reasonably be used to identify any individual customer, user, or specific project. This includes aggregated market benchmarking reports, anonymized cost data statistics used in platform outputs, and platform usage statistics shared with investors and partners.
4.3 Legal Requirements
We may disclose your information if required by law, regulation, legal process, or governmental request, or if we believe disclosure is necessary to protect the rights, property, or safety of Company, our users, or the public.
4.4 Business Transfers
In the event of a merger, acquisition, sale of assets, or similar transaction, your information may be transferred to the acquiring entity. We will provide notice prior to any such transfer and will require the acquiring entity to honor this Privacy Policy.
4.5 With Your Consent
We may share your information with third parties when you explicitly consent to such sharing.
5. Customer-Contributed Cost Data
This section applies specifically to construction cost data and unit pricing contributed by customers under a Pilot Agreement or Data Collaboration Agreement.
5.1 Anonymization Process
All customer-contributed cost data undergoes a mandatory anonymization process before incorporation into any model or database. This process removes all project names, addresses, and parcel numbers (APNs); strips all contractor, subcontractor, and vendor identities; removes customer-identifying information; and aggregates data with other sources so that no individual project or contributor can be reverse-identified.
5.2 Permitted Uses
Anonymized and aggregated cost data is used solely to calibrate and improve the platform’s cost estimation engine for applicable geographic markets, generate market-calibrated cost estimates for all platform subscribers, produce aggregated benchmarking reports, and conduct internal research and development.
5.3 Prohibited Uses
We will never sell or license raw customer-contributed data to any third party; use customer data to provide competitive intelligence about a contributing customer to that customer’s competitors; publish any data that could reasonably be traced back to a specific customer or project; or share unanonymized data with any party other than Company employees and contractors who have a need to know.
5.4 Data Return & Deletion
Upon written request by a contributing customer, we will certify deletion of all raw, unanonymized data within thirty (30) days. Anonymized and aggregated data that has been incorporated into our models may be retained, provided it cannot be reverse-identified.
6. Data Security
We implement commercially reasonable technical and organizational measures to protect your information, including:
(a) Encryption of data in transit (TLS 1.2+) and at rest (AES-256);
(b) Role-based access controls limiting data access to authorized personnel;
(c) Regular security assessments and vulnerability testing;
(d) Multi-factor authentication for administrative access;
(e) Automated monitoring and alerting for suspicious activity;
(f) Regular data backups with encrypted offsite storage; and
(g) Employee security training and confidentiality agreements.
We are committed to achieving SOC 2 Type II compliance as part of our security roadmap. While no method of transmission over the Internet or method of electronic storage is 100% secure, we strive to use commercially acceptable means to protect your information and will notify you of any data breach in accordance with applicable law.
7. Data Retention
7.1 Account Data
We retain account information for the duration of your subscription and for twelve (12) months following termination, after which it is deleted unless retention is required by law.
7.2 Platform Usage Data
Usage data is retained for twenty-four (24) months for service improvement purposes. After this period, usage data is either deleted or permanently anonymized.
7.3 Customer-Contributed Data
Raw customer-contributed data is retained for the duration of the contributing customer’s subscription or pilot agreement. Upon termination or written request, raw data is deleted within thirty (30) days. Anonymized and aggregated data may be retained indefinitely.
7.4 Communications Data
Support tickets and correspondence are retained for thirty-six (36) months. Marketing consent records are retained for as long as necessary to demonstrate compliance.
7.5 Legal Hold
We may retain information beyond the stated retention periods if required by law, regulation, or legal proceedings.
8. Cookies & Tracking Technologies
We use the following types of cookies and tracking technologies:

9. Your Rights

You may request a copy of the personal information we hold about you in a structured, commonly used, machine-readable format.
9.2 Correction
You may request correction of inaccurate or incomplete personal information.
9.3 Deletion
You may request deletion of your personal information, subject to our legal retention obligations and the anonymization provisions described in Section 5.
9.4 Restriction & Objection
You may request that we restrict processing of your personal information or object to processing based on our legitimate interests.
9.5 Opt-Out of Marketing
You may opt out of marketing communications at any time by clicking the unsubscribe link in any marketing email or by contacting us at the address below.
9.6 Do Not Sell
We do not sell personal information. If applicable privacy laws grant you additional rights regarding the sale or sharing of personal information, we will honor those rights.
9.7 Exercising Your Rights
To exercise any of these rights, contact us at privacy@procivilai.com. We will respond to verified requests within thirty (30) days, or within the timeframe required by applicable law.
10. Nevada-Specific Privacy Rights
Under Nevada Revised Statutes Chapter 603A, Nevada residents may submit a verified request directing us not to sell their personal information. As stated above, we do not sell personal information. To submit a request, contact us at privacy@procivilai.com.
11. California Privacy Rights (CCPA/CPRA)
If the California Consumer Privacy Act (CCPA) or California Privacy Rights Act (CPRA) applies to your personal information, you have additional rights including the right to know what categories and specific pieces of personal information we collect, the right to delete personal information (subject to exceptions), the right to correct inaccurate information, the right to opt out of the sale or sharing of personal information (we do not sell or share personal information as defined by CCPA/CPRA), and the right to non-discrimination for exercising your privacy rights. 12. Children’s Privacy
The Service is designed for business use by professionals in the real estate development industry. We do not knowingly collect personal information from individuals under the age of 18. If we learn that we have collected personal information from a child under 18, we will promptly delete such information.
13. Third-Party Links & Integrations
The Service may contain links to third-party websites, services, or integrations (including county GIS portals, municipal code databases, and mapping services). We are not responsible for the privacy practices or content of these third-party services. We encourage you to review the privacy policies of any third-party service before providing personal information.
14. International Data Transfers
The Service is operated from the United States. If you access the Service from outside the United States, your information may be transferred to, stored, and processed in the United States. By using the Service, you consent to the transfer of your information to the United States, where data protection laws may differ from those of your jurisdiction.
15. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. We will post the revised policy at www.procivilai.com/privacy with an updated “Last Updated” date. Material changes will be communicated to registered users via email at least thirty (30) days before they take effect. Your continued use of the Service after the effective date of a revised policy constitutes acceptance of the changes.
